PlainComp is a software tool that produces statistical estimates of residential property value. It is not an appraisal, not professional real estate advice, and not a substitute for the judgment of a licensed professional.
These Terms govern your use of the Service. Read them in full before relying on any output. If you do not agree, do not use the Service.
01 / ACCEPTANCE
ACCEPTANCE OF TERMS
By accessing or using the PlainComp website and property valuation service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is operated by Matt Rybicki, a licensed Arizona REALTOR (ADRE SA712773000) with Keller Williams Arizona Realty ("Operator," "we," "us," or "our").
02 / SERVICE
SERVICE DESCRIPTION
PlainComp is an automated valuation tool that generates property value estimates using comparable sales data and statistical modeling. The Service provides automated comparative market analysis estimates, confidence grading, and AI-generated narrative summaries for residential properties in the United States.
The Service is a software tool. It is not a licensed appraisal service, does not provide professional real estate advice, and does not replace the judgment of licensed professionals.

NOT AN APPRAISAL OR PROFESSIONAL ADVICE
The valuations provided by PlainComp are statistical estimates only. They are NOT real estate appraisals, broker price opinions, or any form of professional real estate advice.
The Service does not constitute an appraisal as defined by the Uniform Standards of Professional Appraisal Practice (USPAP), the Financial Institutions Reform, Recovery, and Enforcement Act (FIRREA), or any federal, state, or local law. Only a licensed or certified real estate appraiser may perform an appraisal. PlainComp is not operated by, and does not employ, licensed appraisers.
The Service is intended to provide general informational estimates based on publicly available data and statistical modeling. It does not account for interior condition, upgrades, unique features, or other factors that a licensed appraiser would evaluate through physical inspection.

NO AGENT-CLIENT RELATIONSHIP
Use of the Service does not create a real estate agent-client relationship, fiduciary duty, or agency relationship of any kind between you and the Operator. Although the Operator holds a real estate license, the Service is a software tool and your use of it does not constitute engagement of real estate brokerage services.
If you wish to engage the Operator for real estate brokerage services, a separate written agreement is required.
05 / PROHIBITED
PROHIBITED USES
You may not use PlainComp output for the following purposes:
- ▮As a substitute for a licensed appraisal in any mortgage lending, refinancing, or loan underwriting decision.
- ▮As evidence or support in any legal proceeding, arbitration, or dispute resolution.
- ▮For property tax assessments, appeals, or any governmental filing.
- ▮For estate valuations, divorce settlements, or insurance claims.
- ▮As the sole basis for any purchase, sale, or investment decision.
- ▮In any context where a USPAP-compliant appraisal is required by law, regulation, or lender policy.
06 / ACCURACY
ACCURACY AND DATA SOURCES
Valuation estimates are generated using comparable sales data obtained from third-party sources, primarily the Rentcast API. This data is sourced from public records and is not MLS data. While we make reasonable efforts to provide useful estimates, we do not guarantee the accuracy, completeness, reliability, or timeliness of any data or valuation produced by the Service.
The statistical model underlying the Service applies mathematical techniques including regression analysis, outlier removal, and weighted scoring. These techniques are inherently approximations and may produce results that differ significantly from actual market values.
Third-party data may contain errors, omissions, or outdated information. We are not responsible for the accuracy of data supplied by Rentcast or any other third-party provider.

DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from the Service will be accurate or reliable. No advice or information, whether oral or written, obtained from the Service shall create any warranty not expressly stated in these Terms.
08 / ASSUMPTION
ASSUMPTION OF RISK
You use the Service entirely at your own risk. Any reliance you place on the valuation estimates, comparable sales data, confidence scores, or any other output of the Service is strictly at your own discretion. You are solely responsible for any financial, legal, or other decisions you make based on information obtained through the Service.
We strongly recommend consulting with licensed real estate professionals, appraisers, financial advisors, or attorneys before making any real estate transaction, investment, or financial decision.
09 / LIMITATION
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of or inability to use the Service, even if the Operator has been advised of the possibility of such damages.
In no event shall the Operator’s total liability to you for all claims arising out of or relating to the Service exceed the total amount you have paid to the Operator for the Service in the thirty (30) days immediately preceding the event giving rise to the claim. If you have not made any payments, the Operator’s total liability shall not exceed one hundred dollars ($100). This limitation applies regardless of the legal theory on which the claim is based, including negligence, contract, strict liability, or any other theory.
10 / SUBSCRIPTION
SUBSCRIPTION AND PAYMENT
PlainComp offers free and paid subscription tiers. Paid subscriptions are billed on a monthly or annual basis through Stripe, our third-party payment processor. We do not directly process or store your credit card information. All payment processing is handled by Stripe in accordance with PCI DSS standards.
BillingPaid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You authorize us to charge the payment method on file for recurring subscription fees.
CancellationYou may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period, and you retain access to paid features until that date. No partial refunds are provided for unused portions of a billing period.
Refund policyWe offer a 7-day money-back guarantee on new paid subscriptions. If you are unsatisfied for any reason within 7 days of your initial paid subscription purchase, contact us at support@plaincomp.com for a full refund. This guarantee applies only to the first subscription payment and does not apply to renewals.
Price changesWe may change subscription pricing at any time. Price changes will not affect your current billing period and will take effect at your next renewal. We will notify you of price changes at least 30 days in advance via email.
11 / ACCOUNT
ACCOUNT TERMINATION
We reserve the right to suspend, restrict, or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, suspected fraudulent activity, excessive automated usage, or any conduct we deem harmful to the Service or other users.
Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive will remain in effect, including intellectual property provisions, disclaimers, limitations of liability, indemnification, and governing law.
12 / INTELLECTUAL
INTELLECTUAL PROPERTY
The Service, including its design, valuation model, statistical methodology, code, text, graphics, and other content, is the intellectual property of the Operator and is protected by applicable copyright and intellectual property laws.
You may use valuation results generated by the Service for your personal or internal business purposes, including client presentations prepared using PlainComp’s PDF export feature. You may not copy, reproduce, distribute, or create derivative works of the Service itself or its underlying methodology without the prior written consent of the Operator.
You may not reverse-engineer, decompile, or otherwise attempt to extract the source code or algorithms of the valuation model. You may not use automated tools, bots, scrapers, or similar technologies to access the Service in a manner that exceeds reasonable use.
13 / ACCEPTABLE
ACCEPTABLE USE
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party’s use of the Service. You may not attempt to gain unauthorized access to the Service, its servers, or any systems connected to the Service.
14 / INDEMNIFICATION
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Operator from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any decision you make based on output from the Service.
15 / DISPUTE
DISPUTE RESOLUTION
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in Maricopa County, Arizona.
Notwithstanding the above, either party may seek injunctive or equitable relief in the state or federal courts located in Maricopa County, Arizona, to protect its intellectual property rights or to prevent irreparable harm.
You agree that any dispute resolution proceeding will be conducted on an individual basis and not as a class action, class arbitration, or consolidated proceeding.
16 / GOVERNING
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.
17 / CHANGES
CHANGES TO TERMS
We reserve the right to modify these Terms at any time at our sole discretion. When we make material changes, we will update the "Effective" date at the top of this page and, where practicable, notify registered users via email. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes.
18 / SEVERABILITY
SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
19 / AGREEMENT
ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Valuation Disclaimer, and Security policy, constitute the entire agreement between you and the Operator regarding use of the Service and supersede any prior agreements or understandings.
